Kalshi access continues in California amid unresolved sports contract questions

RotoGrinders says that as of November 2 Kalshi, a CFTC-designated exchange, is still available to eligible California users aged 18 and older, and that trading there is not a sportsbook. An August 28 Ninth Circuit ruling rejected the argument that federal commodities law automatically prevents states from applying gambling laws to Kalshi sports contracts, and Attorney General Rob Bonta has joined multistate filings backing state authority.

Kalshi remained available to eligible California users aged 18 and older as of November 2, according to RotoGrinders. That access continues while the legal position of its sports contracts remains unsettled.

Access and legal status are separate

RotoGrinders describes Kalshi as a CFTC-designated exchange and distinguishes trading on the platform from using a sportsbook. Its availability in California does not, however, resolve whether state gambling laws can apply to its sports contracts.

The distinction matters when interpreting the current position: users’ ability to access the exchange and the scope of state authority over its sports contracts are separate questions.

Court ruling leaves state authority in play

According to RotoGrinders, an August 28 Ninth Circuit ruling rejected the argument that federal commodities law automatically blocks states from applying gambling laws to Kalshi sports contracts.

Attorney General Rob Bonta has also joined multistate filings supporting state authority, RotoGrinders says. Those filings and the court ruling are part of the unresolved legal backdrop to Kalshi’s continued availability in California.

What it means for prediction markets

  • Availability is a dated observation: RotoGrinders’ account establishes access for eligible California users aged 18 and older as of November 2, not a guarantee of future access.
  • Federal designation does not settle the state-law question: The August 28 ruling rejected automatic federal protection against the application of state gambling laws to Kalshi sports contracts.
  • The uncertainty concerns sports contracts: Continued access to Kalshi should not be read as a definitive resolution of those contracts’ legal status.
