Twelve Trades for $114.87: Utah Put Kalshi's Founders on the Charge Sheet
The evidence is small. The charges are not. Utah Attorney General Derek Brown filed a criminal complaint on October 29 naming Kalshi chief executive Tarek Mansour and chief operating officer Luana Lopes Lara as defendants, after an undercover agent placed 12 sports trades on the platform for a total of $114.87.
The complaint carries 12 counts of online gaming promotion plus a single count of pattern of unlawful activity. It landed less than two weeks after Utah sued Kalshi in civil court, calling gambling a public nuisance that inflicts substantial harm on state residents. Utah bans gambling outright, and Brown's position is blunt: calling a bet a prediction market, and holding a federal registration, does not put a company above state law.
Kalshi called the filing a crazy overreach and said Utah is clearly playing politics, vowing to stop it in court as it did in Arizona. Arizona was the first state to bring criminal charges against Kalshi earlier this year, and a judge later put that case on hold. The legal map is now fragmented across roughly 20 states, with federal circuit courts split on whether sports event contracts are swaps, while the CFTC has sued at least 10 states to stop them regulating the platforms.
That is what makes Utah different. Civil suits argue about jurisdiction. A felony complaint names people. The timing sharpens the contrast: the charges arrived in the same week Kalshi completed a $1 billion raise at a $40 billion valuation. A market big enough to be worth $40 billion is now big enough for prosecutors to test personally, and legal analyst Daniel Wallach calls Utah a bellwether for how other states approach Kalshi and Polymarket.
