Spain keeps prediction markets within existing gambling licence rules

Spain's DGOJ said at MERGE Madrid on October 30 that prediction market products qualifying as gambling under Law 13/2011 require a Spanish licence, and it announced no dedicated licensing category. Proceedings opened against Polymarket and Kalshi in May remain without a public ruling, and both platforms remain blocked in Spain.

Spain’s DGOJ has reaffirmed that prediction-market products falling within the definition of gambling under Law 13/2011 need a Spanish licence. The regulator outlined that position at MERGE Madrid on October 30.

The statement makes the product’s legal classification central: the licensing requirement applies where a prediction-market offering qualifies as gambling under that law.

No separate licensing category announced

The DGOJ announced no dedicated licensing category for prediction markets. Its stated position leaves qualifying products subject to Spain’s existing gambling licensing requirements rather than a separate framework.

Proceedings against Polymarket and Kalshi, opened in May, still have no public ruling. Both platforms remain blocked in Spain, leaving their access status unchanged as of November 4, 2026.

What it means for prediction markets

  • Classification determines the requirement: Prediction-market products that qualify as gambling under Law 13/2011 require a Spanish licence.
  • No dedicated route was announced: The October 30 statement did not introduce a separate prediction-market licensing category.
  • Access and proceedings remain distinct: Polymarket and Kalshi are still blocked, but the proceedings opened in May have not produced a public ruling.
