Ninth Circuit denies Kalshi's request to rehear its Nevada sports contracts case, leaving state enforcement in place, Legal Sports Report reports
The same three-judge panel that ruled against Kalshi in August unanimously denied both a panel rehearing and rehearing en banc, and no judge requested a vote on full-court review. Kalshi now has 90 days to petition the U.S. Supreme Court, while the panel's finding that its sports event contracts likely do not qualify as swaps remains in effect.
