Midterm sweep odds hold at 61-62% for Democrats
Polymarket prices a Democratic sweep at 62%; Kalshi is near-identical at 61%.
Democrats are favored to win both chambers of Congress in the Nov. 3 midterms, with Polymarket pricing that outcome at 62% and Kalshi at 61%, according to news.bitcoin.com. The closely aligned readings put congressional control at the center of the cryptocurrency industry’s legislative outlook after the CLARITY Act stalled in September.
Senate control is the closer contest
The Oct. 10 snapshot of Polymarket’s Balance of Power market showed more than $21.2 million in trading volume, while Kalshi’s equivalent market had approximately $35.87 million. A Democratic House alongside a Republican Senate was the next-most-likely configuration on both platforms, priced at 30% on Polymarket and 29% on Kalshi.
Separate chamber markets show a larger Democratic advantage in the House than in the Senate. Polymarket assigned Democrats a 91% chance of House control and projected a 234-201 majority. Its Senate market put Democrats at 63%, with approximately $6.23 million traded and a projected 52-48 majority. Kalshi’s Senate contracts priced Democratic control at 61%, against 39% for Republicans, on $57.3 million in volume.
A legislative reset for cryptocurrency
The Digital Asset Market Clarity Act passed the House in July 2025 by a bipartisan 294-134 vote. It proposed dividing oversight between the Commodity Futures Trading Commission and the Securities and Exchange Commission, with qualifying digital commodities primarily supervised by the CFTC and securities-related activities remaining under the SEC.
According to news.bitcoin.com, Republicans incorporated 126 substantive changes sought by Democrats, but a Senate procedural motion failed on Sept. 15, 2026, in a 49-50 vote—11 votes below the required 60. Every Democrat present and four Republicans opposed advancing it. Disputes included officials’ cryptocurrency holdings, illicit-finance protections, developer liability and stablecoin rewards that could compete with bank deposits.
Any replacement legislation would need fresh consideration when the 120th Congress convenes in January 2027. Democratic control could bring different committee priorities and demands for stronger ethics, consumer-protection and financial-crime provisions. It would not, however, automatically undo existing cryptocurrency policies: Donald Trump would remain president, and legislation would require his signature or enough votes to override a veto.
What it means for prediction markets
- The platforms offer similar snapshots, not certainty. The 62% and 61% sweep probabilities reflect contract prices; developments before Nov. 3 could change them.
- The Senate is the more competitive component. Democratic Senate-control probabilities of 63% on Polymarket and 61% on Kalshi sit well below Polymarket’s 91% House-control reading.
- Election outcomes and legislative outcomes are distinct. A Democratic sweep could reshape a successor to the CLARITY Act, but it would not itself determine whether legislation passes.
- Settlement details matter. Both platforms have specific rules covering chamber control, independents, ties and delayed election results, according to news.bitcoin.com.
