Kalshi CEO Tarek Mansour warns state-led regulation would push prediction markets offshore
Quiet quarter-hour — no significant new platform headline in the last 15 minutes, so this fresh Oct. 14 item leads, in a legal/regulatory category different from the…
Kalshi CEO Tarek Mansour warned on October 14, 2026, that putting prediction markets under state oversight would drive the industry outside the United States. Speaking at DC Fintech Week in Arlington, Virginia, near Washington, he argued that federal supervision is essential to keeping the business domestic, according to CoinDesk reporting cited by The Cryptonomist.
The warning comes as states challenge Kalshi’s sports-event contracts as unlawful sports wagering. Kalshi and its exchange regulator, the Commodity Futures Trading Commission (CFTC), maintain that federal law supersedes state gambling restrictions and gives the agency exclusive jurisdiction.
Conflicting rulings put jurisdiction in focus
The court record remains divided. According to Bloomberg Opinion’s October 12, 2026, report, two federal appellate courts had ruled for states and another for Kalshi. New Jersey, which lost the case favoring Kalshi, has requested Supreme Court review; 39 states and the National Football League backed that request with briefs the previous week.
The dispute extends beyond those appeals. Ars Technica reported on October 8, 2026, that litigation in about 20 states was examining whether Congress meant federal authority to displace state limits on prediction-market bets. Its reporting also noted that Title VII of the Dodd–Frank Act empowered the CFTC to regulate swaps and decide whether to prohibit sports-event contracts, rather than imposing a congressional ban outright.
Federal rulemaking and Kalshi’s defense
According to The Cryptonomist, the CFTC issued one rule and proposed another last week to expressly bring event contracts within its definitions of swaps. Those steps reinforce the agency’s jurisdictional argument while the courts consider competing interpretations of its authority.
Mansour contends that event contracts fall within the Commodity Exchange Act, pointing to its coverage of agricultural futures, oil, metals and swaps. With sports betting accounting for a rapidly growing portion of the event-contract business, he also disputed the argument that sports contracts lack sufficient economic significance to qualify for federal financial regulation.
Separately, Kalshi rejected allegations that its bitcoin and ether perpetual-futures trading volumes were inflated. Addressing the issue at the same event, Mansour said recurring transaction sizes—which represented a significant portion of volume—reflected market makers submitting orders in fixed sizes, according to The Cryptonomist.
What it means for prediction markets
- Jurisdiction remains unresolved: The split appellate decisions leave competing interpretations of federal and state authority in place; New Jersey’s Supreme Court request is a key proceeding to follow.
- Rulemaking and litigation are separate developments: The CFTC’s actions strengthen its stated regulatory position but do not themselves settle the court disputes described in the reporting.
- The offshore warning is Mansour’s assessment: It is an argument about the consequences of state oversight, not a reported relocation decision.
- Volume allegations remain contested: Kalshi has offered a market-making explanation for repeated trade sizes; the supplied reporting does not establish that volume was inflated.
