CFTC locks in federal jurisdiction on event contracts

Interim rule excludes casino-style gambling; proposed rule folds sports, politics, weather in

The U.S. Commodity Futures Trading Commission took two regulatory steps on Oct. 9, 2026, to strengthen its claim to exclusive oversight of prediction markets, according to CoinDesk. One rule took effect immediately; the other remains a proposal. Neither resolves the continuing court fight over states’ authority to regulate the platforms.

Two measures with different legal status

The interim final rule excludes casino-style gambling from the definition of a swap. It is already operative, although the agency will accept public input during implementation. The distinction addresses a central challenge to the CFTC’s position: how to bring event contracts under federal derivatives oversight without also sweeping ordinary casino and sportsbook wagers into that framework.

The separate proposal would expressly place event contracts tied to sports, politics, culture and weather within existing swaps regulation. Such contracts trade on platforms including Kalshi and Polymarket. The proposal has a 30-day comment period, according to CoinDesk; its treatment of those contracts is not yet a final rule.

A regulatory response to a court fight

Several states are litigating against the CFTC, asserting authority over sports betting on prediction-market platforms and, in many cases, accusing the companies of operating illegal gambling businesses. Federal appellate outcomes have been divided: one decision went against the states, while two supported them. States and former federal officials involved in developing the relevant laws submitted their objections to the U.S. Supreme Court this week. The court has been asked to settle the dispute.

TD Cowen policy analyst Jaret Seiberg described the interim rule in a Friday client note as an attempt to strengthen the agency’s courtroom position, CoinDesk reported. States have argued that the CFTC’s interpretation of swaps would render wagers at state or tribal casinos and sportsbooks federally illegal. Seiberg questioned whether the new rule would successfully answer that argument.

The measures had entered White House review less than two weeks earlier. They advance Chairman Mike Selig’s position that prediction markets belong under the CFTC alone—a view shared by companies such as Kalshi. If the agency must defend that position before the Supreme Court, it can now point to regulatory action already underway.

Selig is currently the only commissioner on a commission designed to have five members, allowing him to determine agency policy on his own, according to CoinDesk. President Donald Trump has so far declined to nominate additional CFTC commissioners. The Securities and Exchange Commission likewise has only two members on its five-member commission, amid an administration effort to remove or reduce Democratic representation at regulatory agencies.

What it means for prediction markets

  • Implementation and proposal are distinct. The casino-gambling exclusion is effective immediately; the explicit inclusion of event contracts remains subject to a 30-day comment process.
  • Exclusive federal oversight remains contested. The CFTC’s actions reinforce its legal position but do not settle the conflicting appellate decisions or the dispute presented to the Supreme Court.
  • The scope extends beyond sports. Political, cultural and weather-related contracts are also covered by the proposed swaps treatment, making the rulemaking relevant across prediction-market categories.
